Landlord Violations in Monmouth & Independence
Here is a list of your rights that are guaranteed as a renter in Monmouth and Independence. If you understand these basic issues that many renters have problems with in their rental unit, then you can empower yourself as a renter and increase the standard of living that you deserve!
Structural Conditions
- Stairs leading to residence must be safe to walk on
- Stair and balcony railings must be strong and stable
- Floors, balcony, and/or deck must be to walk on, broken, or deteriorated
- Residence cannot have a ceiling sagging or falling in
- The roof must prevent rain from getting into residence
- Residence must have adequate roof drainage to prevent dampness in the walls or interior portion of the building
Grounds
- The ground must be kept free from any overgrown vegetation that is an obstruction or problem
- There cannot be an accumulation of debris on the sidewalks or other traveled paths
- Trash receptacles must be kept clean and prevented from overflowing
Electrical Conditions
- Light fixtures, inside and outside, must be in good working order (excluding burnt out bulbs)
- The electrical system cannot be hazardous due to poor maintenance (example: electrical wiring cannot be exposed)
- Any provided appliances must be in good working order
Ventilation Conditions
- Mold cannot be present in the residence
- Bathroom must have adequate ventilation (either with a window and/or a working fan)
- The residence must be kept free from all lasting dampness
Plumbing Conditions
- Toilets must be in good working condition
- The water heater(s) must be reliable and adequately heat water
- Pipes in the residence must be in good condition & free from contamination (example: lead)
Heating Conditions
- Residence must be able to maintain a temperature of at least 68 degrees in all rooms throughout the year
- Heating cannot be relied upon by a space heater
Security and Safety Conditions
- Residence must have at least one present and working smoke detector
- Exterior doors and windows must lock securely
- All exterior glass windowpanes must be free from cracks and holes
Infestation Conditions
Residence must be free from insects and rodents
